Summary

Court rules on New York law requiring a person to show a special need for self-protection to receive an unrestricted license to carry a concealed firearm outside the home

Federalism Implications

New York proper-cause requirement is held to be unconstitutional. In a dissenting opinion, Justice Stephen Breyer argued that states should be able to pass restrictions in an effort to prevent gun violence. The Court's decision was said to "severely burden" the States' efforts to do so
